There are tons of people doing just that on dazzle or cafepress. I would imagine that he could sue if he wanted to, but hello - this is free grassroots press - other people spreading his cause which is why it's pretty safe. I'll try and find some more concrete evidence for you, but in the meantime I wouldn't worry about it.
