Although lots of people are doing it, bottom line is that selling any product using Obama's image is illegal unless you have his written permission to use his likeness for a commercial profit-making enterprise.
As Mahalo stated, he isn't likely to sue you for it because of the publicity, but think about what he might do if he loses the general election. Then he might sue everyone he can to recover all the money he will have lost campaigning for nothing. You are definitely taking a risk if you end up making a profit on this without his permission.

Can you barack obama's name and slogan
Hello,
i am a visual artist and fine arts photographer. I photograhed senator obama recently at a public rally and have some greats photograhs that i would like to print them on tee-shirts to sell for profit. Is it illagal to sell anythng with obama's name, or his slogans on it..for instance "yes we can"
q:is slogan public domain....or a famous person's name or likeness...
