Election rules

If the states of michigan and flordia's votes for a democatic nominee are not allowed this year as it looks they are not, will this be a fair election? And will the losing canidate have a cause for a lawsuit to have these counted. At the very end, i knw they have just said these votes will not count, but what i do not understand is how can this be fair does this mean the people that voted, voted for nothing and that our voices do not count. Can anyone out there help me understand this please.

The votes that are not being counted only for the primary elec not the general in nov.
