Didn't you file legal separation paperwork? That would have established custody. If you had left and he filed, you will have to wait until you go to court. How long were you gone? Was it during the specified period of your 50/50 verbal agreement? Did it go over? It hasn't been signed by the judge because there is a date.. He shoudl have served you w/something. File a response asap and show up for your court date. IF he didn't go to the court house and see when it is...and let them know he didn't serve you. He doesn't have to give them back to you until a judge tells him to. I am sure he foudn that out. You probably won't see them until the court date. Good Luck.

How do I get my children back
My husand and I been seperated for 5 months. We agree 50/50 custody. I filed child support and got it. A few days later I had to go out of town with a friend for medical reasons. When I returned he would not give them back. He knew where I was going. He set me up. He filed for custody which hasnt been signed by the judge yet. How do I get my kids back. I called the police and there was nothing they can do because there is no court order.
