You can file for custody you have that legal right but it is hard to prove to the court that a parent is unfit. If you feel you have enought evidence to show the court that the mother is unfit I would of course try. I have seen it tried many times and it is hard and costly. As a father i can see your concern and would do what ever it took to try. The child needs to be in a sake enviroment.
