How to apply for full custody in Houston, TX. ?

I live in Houston, TX. my boyfriend and I have one son and one on the way, he doesn't help take care of him so I went and filed child support on him. He refused to go to court. He tells me if they serve him, the money he's not giving me he will use to get a lawyer and fight me for custody. Our son is 11 mths old and he has only given me $200.00. Now Im 26 wks pregnant with our son and he wont even help me prepare for this one. I dont know what to do I don't want to send my son through this.

Don't worry he is full of it he is threating you because he wants to scare you off of doing anything. This is the way it works. You are not married. I don't know if his name is listed on the birth certificates or not. If not that can be a good thing for you right now and if he is still that is fine. You need to file for sole custody of the children and when you go to court your boyfriend will get stipulated visits with the children and child support will be ordered at that time. The courts do not just give the father custody. He is not going to get away with this believe me he will pay child support or end up in jail and they can also garnish his wages if he refuses to pay. If he is not on the birt certificate then the burden of proof is upon him to prove he is or isn't the fatherand in the mean time you can get child support. You can also go though free legal services they go by your incom so if you don't make much money you would quartilfy.
