My rights to get an objectional person to move out of my basement.

My son, wife and 2 children are living in my basement. My son offered to give me money to defray the cost of 4 extra people using my electricity, water, waste and recyclye pickup, cable, heat/AC.
There is no lease involved. It's a family situation and not an apartment. I wouldn't think that counts as rent. I also do the wash for the whole family and take care of the 2 children quite often. My son can't afford to move out. She can never keep a job to help pay for an apartment. She either gets fired or quits.

I am 76 and my husband resides in a nursing home. I feel she has so much damage to us and the house

My major question is that I do not get along with the wife. She has trashed my basement and is completely irresponsible. She has caused nothing but acute stress. I need to know my rights about her. I would like to have her leave. My son and her are now on the verge of divorce.

Is there any lawful way to make her leave without the rest of them
having to leave? Is there any solution that won't hurt the kids and my son?

If things are as uncomfortable as they are, you can have just her tresspassed off of your property with your local law enforcement. That is the only legal way to get her out of your house, but the recourse from your son would probably make things quite uncomfortable for the family.

Your best bet would be to ask the whole family to leave. Tell your son that you don't appreciate what she is doing to you and to your home. Tell him that he and the kids are welcome, but not as long as the wife is around. Maybe he will get the picture that way.
