If CPS is aware of a child being abused it is their oblagation to take that child out of the home, they will usally tell the parent that the child is residing with that they have to contact a family member to come take the child or they will take the child in custody. this happened to my daughter and she called me and i have had my granson from the age of 4 and he is now 18 and just gradurated. All cases are not like this the parent can get help and ask for the child back. But has to prove to the court there has been some treatment for the abuse.
