Well since the boy is not in the home then this might be a good time to file for custody. The courts may find that this might just be in the best interest of the child. The mother may fight you but if he is already in trouble and been out of the home that is going to hurt her not help her. You will need to prove to the court why you feel it is in his best interest to be placed with you. they will ask about your incom like if you have a full time job and you can't have a crimmal record. I hope your able to do this it sounds like you care alot. you might even talk with your mother and see if she would agree to give you tempoy guardianship that would make it easy on all of you. You would just have to go online under free legal forms and get the guardianship papers and all your mom has to do is consent allowing you to file for the guardianship. she may want to try this and see how it works out. you can file the papers at the court house. Also they have a wavier of payment if you are not making alot of money,if you are then she can get the wavier if she is not working. The wavier is also on line under legal forms and would have to be filed at the same time as the guardianship papers.Good luck

Fighting to get custody of my brother
I'm wanting custody of my brother but I know my mother will fight me on it and things are really bad where he is at now. I need to know how to go about trying to get custody of him with out him being put into a foster home while everything is going on. Right now he is in a detental home because he was missing school and missing a court date, but it was not all his fault, my mother is a big blame in all this because she has a very bad drinking problem. What should I do?
