Moving Home

My husband told me 6 months ago to leave our home. I did. We live in Maine and are not legally separated or anything. We own the home together. He still lives there and I am renting an apartment with our 2 children. I now want to move back to our home. Can I do that even though he may not want me to?

If your name is on the house, and there is no court order preventing you from residing there, and you are not legally seperated, you can do one of two things, just move back in, it is your house, or go to the courts, file your seperation papers and ask the judge for temporary custody, and the legal right to reside soley in the home with the children, this will force your husband to have to vacate the home until a final seperation or divorce agreement is reached.
