Can I paint and sell a painting that I have photographed the image from a live tv program?

I photographed Nadal playing in the French Open, from my own tv. I have painted a picture of him and want to sell prints. I consider the photograph my own, do I have to ask his permision to sell the painting or prints?

Absolutely......NOT! Since it has already been broadcasted, nationally / internationally, the TV Station that televised that event currently holds those rights who themselves had to receive permission and obtain clearances. Now, if you were present at that particular event and you photographed it with your own camera and wish to paint what you have captured--then YES. You can paint and sell the prints at your leisure, but here's the catch...you will still need permission from Nadal, who played / participated in the French Open to "sell" those paintings. Some people who are famous or famous for being infamous don't mind, but it's the matter of respect for that individual is what will set you apart from the rest and keep you from those hefty legal fines.

One more thing, even though a lot of portraits are beautiful inspirations that derived from either famous people or unforgettable events, you should always protect yourself legally. Do your research!
