Yes my insurance had to pay for the rental of a car for me and for the total loss of my car. It was too damaged to fix it. Not to mention the ambulance and evaluation of the doctor and loss of wages. Due to not having PIP and UIM in my insurance I loss out on these benefits.
Sorry you're having to go through this. You could sue him for damages.
You'll win your case -- but if he doesn't have anything, you won't get any money.
A ticket could not be issued because he showed he had insurance card that was good at the time of the accident. Have you gone to court yet ,,, he most likely will be charged in court for driving with no insurance ,, Because they couldnt catch the lapse till later on. Also if there is no court , then you have to make a citizen complaint at you police station. Good luck with it
