Backed into a motorcycle on private property

My oldest son backed his car into one of my other son's friends motorcyle in my driveway. I had told the owner of the motorcycle on two different occasions not to park his motorcycle on my driveway (I instructed him to park it on the sidewalk connected to the driveway) because he tends to park about a foot from the rear bumper, right in the blind area where you can't see the motorcycle from inside the vehicle. That is exactly what he did to my oldest son, my son got in his vehicle to leave my house and backed into the motorcycle just hard enough to know it over. Now his insurance is threatening my oldest son because he doesn't have the money to pay for the damages ($3000.00). If we refuse to pay do we stand a chance in court?

If there wasnt a police report then there is nothing to worry about. I relly don think they will take you to court for 3,000 dollars because they will spend close to that for lawyers and filing paperwork. I wouldnt stress too much over it. You did your part in warning him about parking there.Make sure others heard you tell him about not parking there just in case.

Actually I do not agree with Tommy on this one. They can take you to small claims court for about a $50 fee & try to win the case, no lawyer needed. Will they win or will you win? That will be up to the judge. Take your witnesses with you, & pictures of driveway & place where u told him to park.
