Careless driving

A woman pulled out in front of me resulting in an accident. It was clearly her fault and she said she did not see me. Come to find out she had 4 dogs in the Mini Van with her. I asked the policeman did he think the 4 dogs could have been the distraction that caused her to not see me and he said it was possible. My question is this.. We would have had the car paid off in about 2 years but now I am going to have to start all over again and we really dont have the money to. Even though I did not get physically hurt is there anyway to file a lawsuit for the woman carrying around 4 animals with her?

Did she get a ticket?

Her insurance didn't pay to get your car repaired?

I do not know if she was issued ticket yet. I get the police report tomorrow. My car is totaled no way to be repaired.

I don't think you can blame it on the dogs.

If she was found at fault, she should get a ticket and her insurance company should be paying for the damages to your car and your body if there are any.

So there is no recourse for the fact that the woman had FOUR loose dogs in the mini van with her? It is irritating enough seeing people with one dog in the car climbing around.

I don't think so, no. Just like there is no recourse for people who are talking on cell phones in states where that is still legal.

If she cut you off, it should be because it was her fault, and if she was distracted by the 4 dogs, then that is her problem and her insurance should go up accordingly to the accident.

Just make sure the cop issues her a ticket for being at fault then go after her insurance company to make sure they pay for all the damages to your totaled car.
