Who gets a ticket if a passenger fails to wear the seatbelt? The passenger (over 18) or the driver?

Always the driver , he or she is in control of the car, and is reponsable for his riders, he is to make sure each rider wears a seat belt, and if they dont , he can put them out, and he gets the ticket , because he didnt make them obay the laws,any time , he or she is the driver, they have complete say in every thing that goes on in the car,
