Engine damage after oil change

Midas put a defective oil filter on my auto. They have admitted fault. Their insurance company says that I will have an out of pocket expense of 555.00, to replace the engine. Is it possible for the responsible parties insurance company not to pay the total expense of these repairs? They say the engine had 21000 miles and they have to depreciate that much use from the total of the engine repairs. Is this the law?

You may have to fight with the insurance company. I understand why they have to depreciate the engine, but you would not have to replace the engine if they didn't mess up. Insurance companies are trying to save a buck, so if you can call to get them to pay at least the majority of it.

I had a car die from when I think the place I had my oil changed not putting oil back in the car. I didn't even think to look at the oil filter to see if it was intact or a bad one. My engine seized up and died.

That is good that they have admitted it was their fault and willing to replace it.

Deducting the 21,000 miles on it due to use makes no sense at all. Maybe they are saying you have to pay the $555 as it is their minimum that they have with their insurance company for damages like this that they do.

That doesn't sound right at all, since they are the ones at fault they should be paying to replace it for you.

Engines aren't cheap, when I was looking into engines for my car, they were all $3,000+ for a rebuilt engine. So only having to pay $555 would be a cheap way of going about it. and even cheaper if you can get them to pay for that.

So much for the Midas guarentee huh. I have to agree with Jodi here, you would not have had to replace the motor if they had not messed up. You could try getting your car companys warrenty people to help you argue this with Midas.

Take them to court! If they damaged your engine because of something they did then they should pay for the replacement of the engine. If the insurance company claims you have to pay them anything they are wrong! They are just trying to see if your dumb enough to pay them money that you don't owe so they can get away with paying less money out on your claim. "DON'T FALL FOR IT " If you say your going to file a court case against them they will pay for the whole thing because they know it's going to cost them more money for attorney fees and court costs and their thing is to save the company money not to spend more out on claims against them.
