If my husband dies, do i have to pay for his debt?

My husband passed away and he had a car. He has not made payments on it for a couple of years. Just today, 10 months after he died, the car company is calling me wanting to come and pick up the vehicle. Do i have to turn the vehicle over to them? the car was in his name.

If the car was in his name, then they should be able to pick it up.

if the debt is also in your name, then you might have to. if it was only in his name before you were married, then maybe not.

i'm sorry for your loss

This doesn't pass the smell test. I've never heard of any finance company taking 2 years of no payments before they attempt to repo a vehicle. If it were me, I'd try to verify the debt with them first. If you can't locate the records, ask them to send you verification of the debt and send the request by certified mail so you have proof on your end. How was his estate handled? Did it go through probate or did he have a will? The car should be in your name by now otherwise, how could you sell it if you needed to?
