Paint job price goes up when finished

I had a verbal agreement with a private person to paint my car for $4500 plus materials. I paid him in full and purchased all of the materials for the job, a total of $1500. 13 months later he calls me and tells me the car is finished. I go there and the car is parked outside, blocked in by other vehicles. He now informs me that he needs another $3200 before I can take the car home. He painted the car in his garage, and it is not a $10000 paint job. What are my rights ? Is this some type of criminal fraud?

What? That is quite a bit to paint a car.

So you had nothing in writing, nothing stating that he was going to paint it for the agreed arrangement?

No. Nothing in writing. Also I was there helping a couple of hours a day for several months

Yeah this sounds like you are getting ripped off! I would take him to small claims court!

No, sidelko it's not that much. i know what this job was. it was rotten windows in a chevelle or 442 that got all new metal.glazed all wiggles and dings, i'm betting i'm right. but seriously if he didn't put a mechanics lien on it you go there with the cops and he's gotta give it to you. when you paid him was it in a check?

Rodadler is right, If it's a build/paint job, It's cheap.
if it's a simple deal of painting a car that had faded paint, Then, It's high.

Okay, That said, The guy should stand behind his word.
You are getting the run around, He took over a year. He is holding the car.
I would bet the car does NOT have a mechanics lein.
Do as robadler said,
Take the cops with you and get the car. Tell the guy you will discuss it in court, Otherwise forget it.

If you can afford the extra $3200, Do this,
Get a reciept detailing the advance cash, the material money, and the balance.
Tell him you WILL NOT accept that paint job for the money you paid.
I assure you, He will lose money on it after "Making the customer happy"
Be sure to let him know that you are not paying a dime till the car is ready and you are not waiting another year.
'Get it done ASAP, and I will pay the other $3200.'
Be sure to get a detailed reciept before confronting him on the quality and DO NOT give him any money till you take the car.
Also, your not paying for more material, If he did it right the first time, the material you bought would have done the job.
