What are my options on getting my money back?

I paid 250.00 for a 1987 chevy astro van to a friend of my sisters. She gave me a bill of sale. She promised to bring me the title the next day and I was to pay her 50.00 more dollars. She didnt show up the next day and I couldnt reach her by phone. I then called the police and filed a police report. I found out her sister in Alabama had brought it to her to drive and she didnt own the van according to her sister she was buying it from a man in alabama. This was in september 2007. The sister got ugly with me and said she didnt sell me the van. She said she would come here in two weeks and get the van. I havent heard from any of them. The tag has exspired and I live in the city limits and all vehicles have to be tagged. What are my options? it has been 4 1/2 months. I am worried the city will give me a ticket. I am mad because she swindled me. Can you advise me?

Take her to small claims court! They'll make her give it to you!

Take her to small claims court most states charge around 20.00 fee for you to file it in small claims court . You do not have to have a lawyer you just tell what happened to the judge and submit any proof you have and the judge will rule on your case.

Sounds like a case for Judge Judy huh? LOL Take the party that sold you the van to small claims court and any tickets or impound fees are on them not you because you haven't legally taken ownership of the van until the title is signed off into your name. BTW the any accidents that may happen might cost the actual owner money? If the one that sold you the car did so without legal ok by the owner they could go to jail. Something that you might let them know. That is like borrowing a friends car then turning around and selling it don't you think? Just to be safe I think now that you know that the van might belong to someone else and not the one that sold it to you, I think I would stop driving it? You might want also want to call the police and ask them what to do? The party that sold you the van could be in really big trouble?

If you have a bill of sale you should take her to small claims court,you will win. You will want to take a copy of the police report. She could get in alot of legal trouble. If she does not have the tilte she will have to give back the money. If the car gets towed then it would be up to the owner to get it out so that won't cost you. However this is wrong and she should not only have to pay you back or give you the car,she should go to jail for fraud. I hope the courts are fair to you I am sure they will be. Good luck
