Adoption of my son by my husband

I have a son who is 6, his father pays child support but never calls him, doesnt come to see him or anything. I want to know if I can have his rights stripped and allow my current husband to adopt him. He just recently started paying child support, and he has only seen my son 2 times before he was a year old. My son couldnt pick his father out of a crowd, and if you ask him who is dad is he says its my husband. What would I have to do in this case to be able to allow my husband to adopt my son, and keep his father from interfering in his life, as all he is doing is calling when he wants too, and confusing my son.

No, there is no possible way you can strip the rights from the biological father, unless you can prove him an unfit father, which in this case, hes not at fault

He would have to sign his rights of being a father over to your husband.

so it is something that you would need his consent for.

You could just ask ex to give up child so new hubby can adopt him. He would not have to pay child support, he might like the idea, & do it.

Ok what you would have to do is get him to sign over all his rights but the thing is if your husband adopts your son but the thing is the judge can rule that your baby daddy doesnt have to pay child support
