As an unmarried mother to be; may I give my baby it's father's last name at birth?

I am divorced, but still carry my married last name. I am now expecting a child with my boyfriend. My child will be born in West Virginia. Will my new born child automatically be born with my last name or can it be born with it's father's last name?

It depends upon what you put on the birth certificate. If you want the baby to have your last name then tell them that, you can still put the fathers name on the birth certificate. Otherwise, if you want the baby to carry the fathers last name, then just tell them that is the name you want for your child. The other option is you can hyphenate the name using yours and the fathers names. Good luck, Susu

I suggest you doing whatever you feel most comfortable with, I am 6 months months pregnant and an unmarried mother to be, and yes, she will have her daddys last name. It may cause difficulties in the future, but as of now its what is best, so It is definitely up to you!

You can write any last name you want on the birth certificate, it doesn't even have to be legally connected with the child (as is your case). As long as the "mother" and "father" fields are not forged and are filled out properly, they don't care what you name your child. Consider the positives and the negatives of having a child with your last name (would the father of the baby think it was insulting him for example). Also don't forget that sooner or later you will be expected to explain your choice to your child when he/she gets older, so make sure that you make a sound choice, and that it is the best choice that you can make for your little one.

If your not married to your bf i would leave the baby name same as yours and if/when you change your last name (get married) you can change it then cause if you don't stay with bf and he take kid for weekend he could file custody papers and you wont be able to stop him ** speaking from first hand knowledge my x took my kids across state lines filed charges on me for abandonment then lost his rights to my kids and they had never even been out of my town before this was all in a 2week time no lawyer up there would take my case cause not residents of state no lawyer here will take it cause not jurisdiction now i had to sign adoption papers just to keep them together cant have any contact till they turn 18 my kids were 3, 2,and 6 months old please don't chance it

You can give your baby any name you would like. And it doesn't matter who's last name he/she has, if you list him as the father on the birth certificate then he has legal rights to the baby. For your babies sake, make sure that you do everything legally and with his/her best interests at heart. Good luck!

You can give your baby any name you would like.Even without the father there to sign a birth certificate. By giving your baby its fathers name , that does not give him any rights, unless he signs the birth certificate.But either way, the baby can have any last name u give it.

As I understand it, you may name your child anything you want to. His/her name does not have to match the name of the father on the birth certificate.

Yes you can when i had my first child i was not married you can put any last name you want the baby to have it your baby, mine was also born in West Virginia it all up to you want last name you want the baby to have your or his
