Birtcertificate question

My baby was born on 12/04/07. Her father signed the papers at the hospital, now has nothing to do with us. Is there anyway Holly can carry my last name? Since she is only 3 weeks old I have not sent for her birth record yet. The father was in the process of divorce but that did not happen. Now his wife thinks she has legal rights for visitation. I now have harrasment & menacing charges on her. Does she have a legal leg to stand on? I know the father does, if we go to court, but I think biologically she is out of the equation.

You are allowed to change your childs name once before her first birthday without seeing a judge, obtain the forms from your health department or office of vital statistics.

You should be able to go into the local vital statistics and change the name. If he is on the birth certifacte I dont know how that will work but I am sure they will let you know if there is a problem but there should be one. Your allowed to change name within the first year. As for your babys daddys wife she has no legal leg to stand on she isn't really anything but a step-mom. She will only get to see the baby and all due to what gets worked out for the babys father to have legally and thats it.
