Do I have a right to a paternity test?

I am a 27 yr old male and I was just told that if the girl I was dating never claimed to me that I was the father to the baby that the courts will not grant me a paternity test. Is this true? I would be willing to pay for the court ordered paternity. My ex-gf would like nothing to do with me ever again (for her own physco reasons) and she will not agree to getting a paternity. I am within 4 days of her "conception date" which was givin to her on July 17th. Her conception date was " July 3rd." If she was smart she would get along with me, I have a 5 yr old son that I do everything for and have always played the "yes game" to his mother...anything she wanted...I always said ok, and i'd be there in a minute.... she could get the same thing from me....There are a million women who would love a dad like myself in there kids life....I guess we would call my ex selfish....

If you have reason to believe that the child is yours or could be yours, you have the right to petition for establishing paternity. Depending on what state you live in, the court will provide free legal help and advise you as to the forms that need to be submitted. In California you can find directions on how to file, and what to file at the courtinfo.ca.gov website....but I don't know what your state has to offer in the way of assistance for filing(it wasn't clear as to what state you live in).

The general process: You will have to petition for a motion, serve her, and then at the hearing the judge will order her to comply with the paternity test.

You will just have to provide a reason for the request. The only way she will be able to completely get out of having to comply is if she has already established paternity with someone else.

If you in fact are the father of this child....she is lucky to have a good father for her child.

I am in california and have already went to the courthouse here in sacramento. I have already filled out the paperwork and getting ready to turn it in. One of my lady friends said good luck, etc.,etc and said I had no chance. I boldly told her that I thought she was wrong. There are plenty of women who would get away with not having the guy in there life as the father to there kid for there own selfish reasons. Ill admit, sometimes it would be better for the child if she did get to do that to the father, deny paternity test. I know your only one person commenting but I think were right...my friend is wrong. Im willing to pay the 500$ paternity test, why wouldn't a judge make her go out of the way, for 1-1.5 hours out of one of her days in order to be sure about a lifetime committment...wouldn't make sense. Thank you and if anyone else wants to chime in, feel free!
