Do i have to take child support?

My advice to you would be to IMMEDIATELY file for custody or support or to go through with the child support the state is seeking because of your welfare. If you don't do this now he could actually do what he is threatening and file for custody himself. You could end up fighting for your child and LOSING if you do not act first.

If there is no court order specifying you as the custodial parent/sole managing conservator of the child, he has just as much of a right to take your child as you do. Don't be nice on this one, or you could regret it for a very long time. (I did)

As a single mother of a child, unless he can prove you an unfit mother, chances are very slim that he could gain custody of your child. If you had been married, then he would have had a better chance. But many men use the threat of "I will take the child unless you refuse child support" route. The fact is, men have less rights when they are not married to you. Watch you step, make sure you are being above reproach and go ahead and take what is rightfully your child's money. Custody is already yours without the paperwork because you are a single mother and have been with the child since birth.
