This is considered statutory rape if the parents decide to press charges. You're talking about a high school sophomore and a college grad. The age difference is big, but the maturity level is completely different which is why these laws are in place.

Yes he can def. go to jail. Even if she consented it doenst count, she is a minor. Even if she went to court and said she consented it is still against the law, and that is serious jail time not to mention, sex offender registry
