Virginia child support from teen father

My son has just become a teen father. We will be going to mediation to try to resolve child support. He is 16 and does not have a job. The baby is living with the mother in her parents home. What will the court most likely do in this situation and are my wife and I liable for support in the state of Virginia since he does not have a job?

Since 1996 states including Virgina have passed laws to move child support out of the public assistance realm to the private sector. This has made grandparent's (parents of minor children) responsible for child support to decrease the amount of child on public assistance. So yes, you can be held responsible for child support. If I were you I would teach him how to be a father and make him get a part-time job while he finishes school. Make him be active in the child's life. You have 2 years to teach him to not give up on this poor innocent child who did not ask to be put in this situation.

Would child support be based on my son's income once he has a job or would it be based on mine and my wife's gross income. If the child is our grandson we realize he is the innocent party in this and he would be welcomed into our family.The relationship between the families has not been good because the girl claimed to already be pregnant at the time of conception and told my son that no protection was needed, apparently her intention was to get herself pregnant. We will be doing a DNA test to confirm that the child is his.

Yes - please do get a paternity test! It's amazing how selfish some people can be - I can imagine how that would create tension amongst the families.

What happens in this situation once paternity is established the Custodial parent and her parents will try to reach an agreement with your son, you and your wife - this would be your best option. If an agreement is not reached, then they can petition the judge to calculate support according to Virginia state code. In this situation they would probably not use a typical support calculation. The judge would come to a calculation based on the fact that she lives with her parents and that you are the granparents.

So the answer is really neither. The judge will decide what is fair based on the circumstances. In many cases, if the father has visitation with the child he will be responsible for the cost of health insurance and then $50-$100 a month with an order to increase when he is 18.

I hope that helps. It would be great if you could come to some agreement without the judge awarding it, but I know this is not always possible.
