Cindy:
You have a mess that easily remedied or very hard to remedy.
If the "person" (ex husband or not) has sigend your name on checks and cashed checks etc. without proper authorization it is fraud. Take all the items cashed, paid out etc and go talk to your bank. Depending upon the state most demand deposit accounts have a maximum out of pocket (cost to you) and the bank eats the rest. If you have already done this and the bank hasn't responded. You now have two things to address.
1) call the police and make a report. you MUST be willing to press charges.
2) if this much access has been allowed by "unauthorized" parties, and the bank is holding you responsible, CALL A LAWYER.
If the bank is sueing you.. This must have been going on for some time. Banks are for the most part not quick to initiate laWSUITS. You need to countersue.
Don't walk RUN to a lawyer. The minimal fee associated with theconsultation will determine what course of action you need to take.
Authorized is authorized
Fraud is Fraud
Good Luck!
