Hiring Restrictions

We are an at-will company. An employee was terminated due to lack of work in his division. We have a temp that we want to hire for another position, what are our restrictions?

If the position is the same, you may have some small issues. However, numbers change, volume changes. What you could / couldn't afford then, may not apply now. Additionally: if the "job" is different albeit similiar, you probably have no issues. (anyone can sue you for 100 dollars and a lawyer) Nothing is certain. Even if you do EVERYTHING right it may come back to bite you. Welcome to business. I would venture that if enough time has passed since letting go the old employee, your fine. Maybe eliminating that position (looking back was a mistake), that doesn't stop you from changing your mind. Just change the job description and title and your good. My opinion of course.
