If the position is the same, you may have some small issues. However, numbers change, volume changes. What you could / couldn't afford then, may not apply now. Additionally: if the "job" is different albeit similiar, you probably have no issues. (anyone can sue you for 100 dollars and a lawyer) Nothing is certain. Even if you do EVERYTHING right it may come back to bite you. Welcome to business. I would venture that if enough time has passed since letting go the old employee, your fine. Maybe eliminating that position (looking back was a mistake), that doesn't stop you from changing your mind. Just change the job description and title and your good. My opinion of course.
