How do I go about establishing a Company Name

I will be consulting for a large pipeline company however prior to them sending me the final contractural language they are in need for me to provide them with a Company Name. My accountant didn't feel that I needed to immediately establish the TYPE of company (sole proprietor, partnership, C- Corp, S-Corp or LLC until early December). However how do I go about and satisfy the need to establish and legally use a Company Name?

In this case, use your personal name with a descriptor, for example: if your name were john livingston, use the business name "John Livingston Consulting," or "John Livingston Enterprises." Or you could try "Pipes-R-Us" if that name isn't already in use by someone.

If you do business only within your state, and nobody else is using the name, you might as well register the name, it's usually inexpensive. Go to your state's web site and see if the name you want to use is already in use. Where I live it's the Secretary of State that handles business names.

If you cross state lines or sell your services on the Internet, go to uspto.gov to do national trademark searches. Determine whether or not you'd be infringing on someone else's name. You don't need to register the name, just put it in use - by putting a TM next to your company name. If you register the name you can put the 'R' after your name.

One thing, if you use "R"-Us at the end of your name, Toys-"R"-Us will probably ask you to change your name, they claim rights to the "R"-Us trademark. You'd end up needing an attorney so just avoid the hassle and pick something else.
