How to handle unthical business practice against you at work?

I boss promised me that I will be moved into a higher position (base + commission) Dec 20th, 2007 and it was not done until Feb 3rd, 2008. I asked about my back pay from 12/20/07 thru 2/03/08 and on 2/14/08, he figured out my commission and wrote me a personal check. I obviously declined, he continued to offer me cash and an extra week's vacation. So, I reported him to HR, they did an investigation and found ONLY an inapproriate accounting practice by my boss. I was dissappointed because I guess, I expected more. Unthical business practice to me means alot more, he decieved me, his boss, the IRS/Gov't and he still have a job. It's increbile for me to understand. Can I sue? Can I get the IRS to audit the company? They won't even give me the report on the investigation, I would like to know what was done. Please help.

Sincerely,
Meng

Reporting to HR is the correct course of action. You are luckier than most. He tried to make his offer legitmate by paying.( A RARE SITUATION) The reason hedid so was probably due to not having the authority and/or budget to make this promotion effective until he did. BOTTOM Line the promotion DID happen albeit delayed. The IRS isn't an alternative disgruntled employee department. Sueing is always an option. Unless the amount is significant (tens of thousandsor more) I think you should be glad you have the your money and still have a job. If he still is employed there, the company is not concerned about wrong doing or liabilty exposure, thus an insignificant act or occurance. A call to a lawyer may be worth the minumal fee associated. I AM NOT A LAWYER. just my opinion, sorry you were hosed.

I have to say, I agree with K_st8r. I think you are being a little inflexible and unreasonable. He was going out of his way to make it right for you and you get him in trouble for it. I'm glad he still has his job. You could say he was being unethical in a business sense (which I disagree with), but from the situation above, I think you have been unethical in a human sense.

I'm guess you are in your early 20's and new to the business world. I think you should be a little more flexible next time, there may have been a reason for the delay. Just a thought. As far as suing him, I don't think you have any case. did he put in writing when your promotion would be? Seems like the companies fault not his.
