First the word consumer is a common word therefore Yes you can use it. As to the first part of your question I would seek the advise of a biz lawyer. They would be your best bet as to the consequences of using a name someone else has or better yet do a search for that name on the internet. Hope this helps.

Naming a organization, business, group
Hi, I am starting a work from home marketing program. I want my e-mail to contain the name we selected. this is not a corporation
company or anything big.It is just my family. If it turns out that the name we selected is already being used, what are the consequences. Part of the name uses the word consumer. I know that the word Consumer is used in many names. Do I have to pay some one to use the word "Consumer" in our name. thank You C
