You will have to take your friend to small claims court and sue him for the return of the down payment.
If you can prove that your friend do no work and received the amount that you gave him, then you have a good chance of winning. Be sure that you have a canceled check or other proof that your friend actually received the money, otherwise your friend could claim that you never gave him any money.
