Termination last pay check

Technically, whenever he/she wants. There is a point where contacting the state department of labor will cause an inquiry. Upon the inquiry (weeks sometimes). the dol will determine wether the pay is due or not. If it is due and has not been paid, there will be minor repercussions to the employer. However you will get paid. (wether it is all you are due , may be another story)

They must pay you on the sceduled payday. Withholding a check is illegal in all states. If they are withholding your check call your state labor board.

You are due your final pay check on the next pay period. This is only if you have returned all of the property that you owe them. If you have equipment or uniforms etc that you are supposed to return then they can and will hold that last check until you have completed your obligation as well. Normally this is done on a local or branch level instead of a home office payroll. Is this practice legal. No but they feel it gives them a defense.

If you are not getting paid call the State Dept of Labor or go on line and file a complaint.
