Do trash chute dampers installed in California Condominium buildings have to have a fire damper with a fuseable link?

We have four floors with a trash chute intake door on each floor. In the garage, we have a trash room where the chute funnels the trash into the waiting dumpsters. In this room is a fire sprinkler system and fire doors which are connected to the alarm system.

Recently, we were told that we have to have a damper with a fuseable link so that in case of a fire, the trash chute door will slide shut to prevent fire from going up the chute.

Is this true? We're finding that the replacement cost for the trash chute damper is about $1200.00 for each occurrence.

Are we allowed by law to not install a fire damper in this area?

Yes, this is true. Trash chutes are vertical openings that can carry fire from one floor to the next. The California Building and Fire Codes require that the chute in the termination room close in the event of a fire.
