Can my new husband adopt my daughter?

My divorce final in 2005 in Kansas. I was awarded sole custody with her father having zero visitation rights. We have lived in Texas for almost 3 years now. I am getting remarried and was wondering if my new husband-to-be can adopt her without us having to battle my daughter's biological father?

Bring a Jayhawk down to a Texas court and all you'll hear is "Get a rope;" Seriously no matter whatever happens her bio father will always be her father. That being said adoption is possible but prepare your husband to be about the grilling the judge may give him. It's more along the lines of why he wants to do this. Just remember it's all about the child's best interest (hint, hint) and how much he loves her and you (do you need cue cards)? Get in contact with a lawyer in a family law practice. They have the cue cards. Now go get a Stetson and a pickup. Good luck to all three of ya.

There is no way that you can exspect your new husband to adopt your child/children without the father being notified,it is the law,and you can either get the father to consent,that would be the bet and easiest way, if not then the father has to of not paid any child support within a year,and has not seen his child/children within a year he catcer here is, when the father is served of your intent to allow your new husband to be,to adopt the child/children,all he would have to do is pay as little as $10.00 dollars to the court for child support,ad that would put a stop on the adoption,if he is in back child support erro'r he may sign away his rights alot of fathers do this to get out of child support,I do not agree to this but the states do.
