Child custody/support.

I have a 6 year old from an unwed relationship. With his agreement we moved out to Colorado from NY 5 months ago. Since before moving he has stopped sending the assistance we had verbally agreed upon years ago. When I asked him for financial help he stated he did not have to do anything because he could report me as having kidnapped our daughter. Can he do that and what are my best options. We never took any thing custody or support to court. If I start preceedings now will i be forced to go back if he fights me?

You need a lawyer, and you need to have Colorado declared your permanent state of residence. Then you will file in the courts where you live, Child support enforcment can even do this for you.

He cant get u for kidnapping when there is no legal paperwork filed anywhere. he is pulling your chain, hoping you will let him off the child support thing...DONT..once u have est residence in CO, begin paperwork to have him pay child support. the worse that can happen, is they can give him joint custody to aid in your childs decisions, but they will make him pay support. you need papers. dont let him tell u crazy things and scare you. my ex did that too. be strong. it will be a process, but it will be well worth it in the end...ask for full custody. hopefully you will get it. and you should since he has no interest in taking care of the child for over 5 months now...good luck!

The only way he can get you for kidnapping is if you try to hide your kid from him. You need to go to the FSR and file for child support. I agree that if he is going to try to pull something like that, you need to get yourself a lawyer.

Legally you did not kidnap your daughter since he was never awarded full custody by a court, as far as any financial help you will need to go through court and they will want paternity established. as long as he doesnt deny paternity, all he will have to do is sign some papers. if he decides to question whether he is the father then you will have to subject your daughter to the required tests. once this is done the court will award the child support payments based on his income, and he may be awarded visitation
