How do you get a drug test court ordered on a mother with joint coustdy?

This question has been answered may times and you need to do what the sujestions everyone has given you. This is not a simple thing here, nothing can be done overnight, there has to be some kind of proof to file a modivacation for custody, the court would have to be the one to order the custodial parent to take a drug test, and the court needs a reason to order this, more than just hear say, the courts also have rules to follow. If you do not want to take th advise that everyone gives to help you, then you neeed to consult with an attorney.

Excuse me for being scatter brained this is so stressful. Sadly enough this is very hard to prove anything with out a camera in your hand catching them doing it. The kids want out and it’s breaking our heart. We did have a consolation with a attorney and basically we have to give her 5,000 to take the case and she still did not give us much hope. Because it the kids telling us everything and the mans prison records are from his past it really does not stand in court. They are slick at hiding things and no one will find anything unless they court order a hair drug test. We have reported to DEFACS and they open and closed the case with out drug test. I was just wonder if the only way with an attorney, We are scared for the kids and our stomachs are tied in knots. It’s pointless to hand over 3,500 dollars when the attorney is basically saying we need more to go on! Thanks for your advice

Go to the court house and fill out the form to have it court order to make it faster you will need to get attorney and let them do the work

Well it sounds like you have done everything that you can, if the lawyer is willing to charge you $5,000 and cannot guaratee you anything because he states you need evidence then to me that would say he just wants your money, the CPS has checked out the home and closed the case, probary had they been able to search the home they would of found something but they cannot gt a warrant to do that. Th lawyer is right if the man the mother lives with has served his time for a crime that cannot be used, unless it can be proven that he is doing the drugs now. The court is not going to make the mother take a drug test, just because you believe that she is doing drugs, if that could happen the lawyer would be doing this. I no all this makes you and the father upset, you both care so much and when there is no one out there to help it is hard to except. All you can do is watch the child carefully, give her your support, and maybe the mother will mess up at some point and then you may be able to do something then. Make sure you document everything that you can that concerns you, so when you get enough evidence you can show the court. When the child tells you that she see's the drugs in the mothers room, that might be the time to call the police and report there are drugs in the home, they can get a warrant and then she can be busted, that is the only other thing that you can do.
