Child suport

A girl says i am the father.my name is not on the birth certificate, and I am deployed in iraq. can she still file for childsupport against me? what can I do from Iraq?

Nothing will be done untill you get back and take a paternity test. So I wouldn't worry about it untill then. When you do get back, and if you are the child's father, support will be set then. There is a chance that they will say you owe for the whole time the child has been alive, but you will have 18 years to make that up. Good luck.

She can file for support. The law is that a woman can file for support and state the name of the father even if you are not on the birth certificate . The burden of proof is upon the father. You are not able to do much from Iraq. She can file and if the court orders you to pay you will have to. When you get a partently test taken and it exstablishes that you are not the father the child support will stop. There is a chance because you are in Iraq that the court will not order any child support. I know that our son got a divorce and his wife was in Iraq and she still was able to get child support from him. You should talk to your sagrent.
