Does he need to paY CHILD SPORT

Knowing going into our marriage we both knew my son was not his he signed his birth certitife and game him his name claiming him after he turned 1 years old we split now he wants nothing to do with him he signed a paper to pay but now doesn't is he responable for his up bringing

I would say legally he is the father and would have to pay. The only way to change this is for himto petition the court, take a DNA test on him and child to prove he is not the father (because of the fact that he signed the birth. cert.) and when everything is said and done, he would finally have the childs birth. cert. changed through the state you are in to legally show all changes. But until he does all that and gets in final, he is legally responsible for that child, just as if it was his, or he adopted the child.

If he does a DNA, it will be proven he is not the dad, & no, he is not responsible.

Except in this case, because he knew going into the marriage that the son wasn't his but he signed the birth certificate anyways, might be a wrinkle that the courts would have to decide on as to wether he should have to pay child support or not.

And I'm not sure what the legal cause would be for getting the real dad to pay child support at this point. which is why i think there might be a case your ex would have to pay the child support anyways (DNA or not)

Yes he is responiable to pay child support on this child until the age of eighteen. He knew and signed the birth certificate and now he will be responiable until he turns 18. The only option that he would have of getting out of paying would be if you were to consent for him to give up his rights. If not then he is stuck.
