My ex is taking me to court for MTA custodian parent and to collect support for our 17 yr old.

My ex and I have been divorced for 10 years, and we have joint custody of our 17 year old daughter (will be 18 in June 2009). His visitation schedule was written in the agreement as every other weekend, 4 weeks every summer, Father's Day, and alternating holidays. I have been getting $400 per month since the beginning when my daughter was 7. My ex has never upheld his visitation schedule, and would take her on some weekends but definitely NOT every other, and has NEVER kept her for 1 month in the summer - hasn't even brought it up. I have never increased the support amount,even though I found out he was making MUCH more as years went on, nor did I ever ask for his portion of unpaid medical bills. The current situation is this: for the last 2 years or so, my daughter has found her share of trouble, mostly by hanging around the wrong people. This past May, she had gotten into some trouble again, and decided that she wanted to better herself and start over new. She and her father decided that she would move in with him and his family. She informed me shortly before moving. I agreed only to, once again, be supportive of her. 2 weeks ago, I received a summons for MTA custodian & $400 in support to him. I don't agree with all this, but my daughter doesn't want to come home due to a new job and boyfriend. I feel that $400/month is excessive as he has no daycare expense, and she's never home. Does anyone know Virginia family law, and what are my option

If he was paying you $400.00 a month then the court is going to allow him the same from you. You can file a motion and dispute the amount if you feel that your incom is to low.
