Non custodial parent and collecting support

I am the mom,and the leagal non custodial parent.My daughter who is 15,has been living with me since Aug,2007,with her Dad's permission.He is not helping with her exspenses,and I wanted to know if I could get support from him,being she lives with me,but the custody order from 9 years ago has him the primary custodian.He agrees to sign a paper over for custody,but I was told that it has to be a leagal document order.I asked him to help with her supporting me,but he does not help much.He gives her 40 dollars a month.I want to get support off him,so how do I go about doing this.I payed support for 5 years,when I did not have her.I was hoping not to have to go back through the whole court thing,please help me..

Well if your wanting child support you will need to go back to court. It is better this way and once ordered though the court you won't have to hazzle anymore.
