Proper support for two

I have 2 kids, 4 years old and 2 ears old. My wife and I are wanting to split up. We agree on a lot but she wants over half my pay check. My job is pizza delivery. I make $7.00 per hour but it is only 30 hrs per week. I do get tips some times but I can't depend on it. Mainly because I will work inside sometimes.

You both need to fill out a finciancial statement that the courts have, & they will figure out the child support amt. based on both incomes.

There is know way your wife is going to be able to get half of your incom. She can get between 15 and 20% of your gross incom. You might want to talk with her and agree on a reasoniable amount that you can afford,other wise the court will make the decition for you. You are earning low incom wages so your child support will not be to high until you get a better paying job. If you both go on line and down load the forms for a non-contested divorce and fill out the fianicial report ,you both can stipulate your assets on how you want things to be devided and you can both agree on joint cusody and agree on amount for child support. Your probary looking at $50.00 a month if the court determines the amount,so you might want to either offer her that amount or try asking her to settle for $100. a month until you get a better job. You can also download a wavier for the filing fee and court cost,and that form will also have to be filed at the same time as the divorce papers. the court will approve what the two of you both agree on,but it is imporant that you know that once the order id stipulated though the court no changes can be made within a two year period at least in most states. You might want to consult with an attorney for any legal advice.
