Stepfathers ssd and child support in pa.

I pay support for my 2 children. My childrens stepfather recently won his ssd case and recieved his back settlement of 6 years. My child told me that he got and is getting money for my children. we recenty had a support conference over the phone and my ex wife did not say anything about this money. I called the domestic relation office and asked if this money would be considered income when calculating my support and she couldnt answer my question. I am appealing my support order for other reasons and I want to know if I should bring this queston up in front of the judge. I have been doing alot of research on this and I cant find any answers about a stepparents social security disability. I pay support for two kids and one is not my bio child and after we seperated my ex wife told me that the man she is currenty married to is his bio father. She also told my child that I was not his father and now he does not want any thing to do with seeiing me. she told him that his real father was some guy named John. Do I have a right to request a paternity test to see if his stepfather is his bio father? I have not had visitation with him in over 3 years he is now 15 years old and has no one to call dad. I would love to be his dad but my ex wife took him from me. can you please give me some advice after paying support there is no money to hire a lawyer. Thank you.

You really need to consult with an attorney. I do not believe that the step father can get social securitly benifits for your children. If he is claiming he is the biological father that would explain it but then that would be illegal if your name is on the birth certificate. They cannot get both social security and child support something is fishy here. Even if you did a partinarty test proving your not the childs father it wouldn't make a difference with your paying child support. You would have to sign your rights over for the paternal parent to adopt the child in order to get out of paying child support. You need to find out what is going on and then decide what you want to do.

Thanks for your response. Since I submitted my question I went to court and hired a cheap lawyer when my ex wife was asked about the ssd benefits she denied it under oath. she also lied about her reasons for her not having a job. I then called the social security office and the lady I talked to said that the stepfather could get ssd for my kids if he could prove that he has paid at least 50% of their support and that they dont go by the child support percentages. But I dont understand how he can say he has supported them when he has not worked in more than 7 years, His income was disability and workmans comp.and the money he sued his employer for which was used to build a home. I really got stiffed at the court hearing the judge took her side cause of her lies. If I have proof that she lied under oath is there anything I can do about it? Appreciate any advice you may have. I spent what money I did have on a lawyer who did not do his job.
