Tax deduction

If i have sole custody, the father and i were never married, and he is ordered to pay child support should he be allowed to claim my son every other year on his taxes

That would be up to you and him to decide,if you can't agree on who can claim then the court would stipulate the one that can claim in the custody order.

Is there any written agreement between you two about how to claim the child? if so, just follow that, otherwise see if you can work something out so it is fair for both of you.
