What is considered Back Child Support in North Carolina?

My son has a 1 yr old daughter with a girl he is not married to. They are having problems now and she has filed for "official" child support thru the Child Support Enforcement Agency. How far "back" can she request money legally?

She can request payment from day one but it's up to the Judge. Can he show pruff that he was supporting her prior to the the filing date? With my experiance the Judge most likely starts from the date of filing. Make sure he keeps recipets for any money given to the mom for the baby.

If mom and/or dad were receiving any financial assistance thru the dept of social svcs for the child, and in some cases medical support ie: Medicaid, then the state can establish an administrative order of support back to the date such help was received, which can be from the date of birth. This order will repay the state for the assistance the child received. In most cases, the administrative order or support order can be enforced from the date of birth. If no assistance from the state or county was received, and there is proof that the non-custodial parent provided support for the child, then the order can commence the date of seperation or whatever month the support ceased.

He owes 627.00 in back and 329.00 for this month what can i do child support enforcement is taking a long time and they give him to much time and ae not doing anything it is not right he should be allowed to get away with this

She can only get child support from the time she files,if she has filed before and there is a court order for child support then she can go back from the date of the last court ordered child support,that is calling paying in the rears. If this is not the case then she will only get from the time she files. She can legally file for child support,however if the father did not put his name on the childs birth certificate then he would need to take a parently test to prove that he is or is not the father,if he is not then the child support would then be stopped.
