Well if nothing has been ordered though the court then he does not have to pay child support until she files a motion with the court for sole custody visitations and child support. If they have already got a divorce then there had to be some stipulations on custody. Usally in a divorce degree it states that neither parent can move out of state with the children and if that is a stiplation in his divorce he can file a motion with the court asking for custody because she would be in contempt of court. He may want to check what his divorce degree states. If she is not a resident of the state she is in now that would be to his advanage.
