What is the CA state law for child support?

My Fiance's ex wife took the kids on "vacation" to Arizona and decided to stay for the school year with her new boyfriend. Since she took the kids and kept them out there with out consent from us do we still owe her child support? They are not going through the courts so nothing has ever been in writing except for the docs for the divocrce. What is the CA state law for child support when the kids were taken from us?

Well if nothing has been ordered though the court then he does not have to pay child support until she files a motion with the court for sole custody visitations and child support. If they have already got a divorce then there had to be some stipulations on custody. Usally in a divorce degree it states that neither parent can move out of state with the children and if that is a stiplation in his divorce he can file a motion with the court asking for custody because she would be in contempt of court. He may want to check what his divorce degree states. If she is not a resident of the state she is in now that would be to his advanage.
he can file there and she would need to come back there to court. She has to of lived where she is now for at least 6 months to be a resident. Good Luck!
