Childs rights

I have a question? I have two children one age 14 and 1 age 16 my ex wife and I have joint custody but she has physical custody. my 16 year old would like to move in with me. and go to a new school. she is not willing to let him go. what rights do I or my son have that we can make this happen for him. her reason for not wanting him to move in with me is that she can't afford to lose the child support. I have no problem with paying her but I just want to see my children happy and I want to stand by there side and let them make there own choices again they are 14 and 16

It depends upon what state you live in. Children start to have a voice around age 12 or 13 when it comes to which parent they want to live with.

Social workers and judges understand that forcing children to live where they do not wan to can cause problems.Good luck!

Well It depends on where u live and the child laws there Where I am at the age of 12 the child has the right to express where he or she wants to be and why and it has to be proven that it is in the best intrest of the child. That always has to be proven with any change in the current custody order is that it is best for the child to be with you . Which means your child will have to go on the stand and state that he wants to live with you that might be hard on him. It would be wise that when you repotision the court for change in the custodial matter between you's that you have things to state at teh hearing that are not going to effect the childs schooling so for the courts to decide in the middle of the school year it is not wise to pull the child out and into a new school unless maybe he is getting into trouble there then it would be in the best intrest to the child he trys some with his father. The first step would be to call the court you went through for custody and ask what papers you file and how you start as well as the child laws for teh age he or she can decide or speak on their behalf. Do not tell the judge that she just wants the child support though they do not like being the refs there concern is for the child.
