Child Custody

I have two children and they live with their mother. I have not yet went to court for custody of them. Their mother has just been convicted on two felonies and been put on house arrest for a year. On top of that she has a revoked license, but still drives around with them. There has been examples of neglectful behavior in several situations. She has never been at any resident for more then a year and in the five years of having custody of my children she has lived in about 15 different residents. She also hasnt had a job for more then a year either and keeps jumping around with that. A lot of people tell me that I'm sure to win a custody case with her and be able to get my kids to put them in a better situation. But I worry about a situation 5 years ago, 3 months after my first child, where her and I had got into a situation and I was charged with Domestic Abuse, and it was in a Stay of Imposition for a year and dismissed after anger management and fines. I have not had any further situations since and we had a three year relationship after that and another child even though we aren't togther anymore. Do you think that I would have a chance at being awarded Sole Physical Custody of my children???

Would never hurt to try. It sounds like you could provide a better situation for the kids.

Losing your temper on one occasion, successfully completing an anger management program, and you havn't had any problems in the last 5 years, than this shouldn't be an issue for custody. It sounds as if the children would be in a better environment with you and the Judge will see that too. File a petition and proceed with asking for sole custody...Good Luck!!

You should probably start with trying to get physical custody of the children. obviously the judge didnt hold your prior against you if you arent having supervised visits. it sounds like you have the law on your side, simply because you could provide evidence that she isnt doing what's best for the kids. no child should have to move every few months. my dad went through that as a child. it really sucks and he still wishes he could have kept some good friends for longer than a month. it's hard for a child to settle in to a new neighborhood and school once, much less all the time.

Yes is very likely. Even though you made amistake yrs ago, you sought help for that. Look at all the things she has going on. I'm supprised child welfare hasnt been involved.
