Custody of the grandchildren?

My son is incarcerated in Houston, my daughter-in-law became pregnant by another man and now wants a divorce. Can I get my son's custody of the childred? They are staying with us so they can attend school.

She is capable of helping but she contributes very little. The mother wants a divorce so she can marry the father of her unborn child. She is engaged to him if that is possible since she is still married to my son.

She'll have to file for a marriage license with the new guy. To do this, she'll need to provide her divorce decree -- she cannot be married to different men at the same time.

As for your custody question, I think you should talk to a lawyer, or perhaps the Department of Family and Protective Services. Maybe someone there could answer questions for you: http://www.dfps.state.tx.us
