Custody of unborn child

I am 7 months pregnant and i left my husband of 11 months. i moved back to california and left him in las vegas. when the baby is born in a couple of months here in california can he just come and file for full custody of the baby just because he has a job and the nice place. while i am starting over with my life from basically scratch.

Legally he could file for custody in vegas where he lives and if he does that, you would have to go back there for the court and stuff. but whether he wins depends on how much he has helped you and been around while you've been pregnant. also, he has to prove that you are not fit to raise the child. your job and the fact that you are starting over shouldnt have anything to do with it. the court would rather give a child to a mother who loves her child more than the world, than to give the child to the father who has money and that's all. you will most likely however have to let him keep the child every other holiday and during the summer. the only way to get out of that is if he is a danger to the child. i am finding that it is pretty hard to prove that unless he has harmed you or your child in the past.

He can file. but the judge will have to decide what to and what is best. you are the mom, and unless your life is in shambles, you should be able to keep custody of the baby.
